ICRH Attorneys and Staff Support Local Charities for the 2010 Holiday Season.
Attorneys and staff members in the firm’s Albany and Poughkeepsie offices supported various local charities during the holiday season. Donations included more than $1,000 worth of toys to the annual Toys For Tots drive sponsored by the U.S. Marine Corps Reserve, and an assortment of pet items to the Mohawk and Hudson Humane Society. Staff members in the Albany office also purchased and donated pajamas to the Parsons Child and Family Center in Albany.
ICRH Associate Attends Event to Benefit Domestic Violence Shelter.
Omer Gil, an associate in the firm’s Poughkeepsie office, attended the second annual holiday happy hour sponsored by Young Leaders United to benefit House of Hope in Dutchess County. Those attending the event contributed toys, clothing, gift cards and money for clients of House of Hope, which provides intervention, emergency shelter, and crisis counseling for local families affected by domestic violence. Omer is a co-chair of Young Leaders United, which supports the work of United Way of Dutchess County.

On December 9, 2010, Poughkeepsie associates Penny Hahn and Elliot Fruchtman attended the Beacon Arts Community Association’s (“BACA”) annual holiday gathering. BACA is a not-for-profit organization comprised of members and supporters of the local arts community. Penny Hahn currently serves on BACA’s board of directors. Poughkeepsie associate Penny Hahn recently attended the Defense Research Institute (DRI) Insurance Coverage and Practice Symposium in New York City. ICRH Director of Administration Elected to ALA Regional Management Team.
The firm’s Director of Administration, Mary E. Lawson, was recently elected to serve as a regional officer (Region 1) for the Association of Legal Administrators (ALA). Ms. Lawson was selected earlier this year to complete the unexpired term of another regional officer. Her new two-year term will begin at ALA’s annual conference, to be held in Orlando in May of 2011. Regional officers are part of the national management team for ALA, an international organization that works to promote and enhance the competence and professionalism of all members of the legal management team; improve the quality of management in law firms and other legal service organizations; and represent professional legal management and managers to the legal community and to the community at large. Ms. Lawson has played an active role in the ALA since 1993, when she joined the organization’s Albany Chapter, then known as the Hudson Valley Chapter. As a member of the Albany Chapter, she served as secretary, treasurer, vice-president and president. Ms. Lawson also served on ALA’s Regional Nominating Committee for the Northeast and Mid-Atlantic regions in 2001 and 2008.

Rachel Ryan, an associate of the firm, was elected to serve on the executive committee of the board of directors of Shaker Ridge Country Club in Loudonville, NY, as its second vice president. She is the first female in the club’s history to serve in this position.

Partner Richard A. The event honored Kathy McMahon, the President and Chief Executive Officer of the New York State Hospice and Palliative Care Association and her husband, Jack Ruddick, a former Trustee of the Hospice Foundation, Inc. and a retired General Manager of the Wiltwyck Golf Club. Michelle Almeida, an associate in the firm’s Poughkeepsie office, attended “An Evening to Wine and Dine with Friends” held on October 21 at the Millbrook Winery. ICRH attorneys Carol Hyde, Marcia Smith and Mike Deyo were featured speakers at the Healthcare Financial Management Association of Northeastern New York’s November education event, “Corporate Compliance Programs – Industry Best Practices.” The event was held on November 18, 2010 at the Edison Club in Rexford, New York. Topics included HIPAA Security Audits and Best Practices, Breach Notification Requirements, the False Claims Act and other Key Statutes, and the Self-Disclosure of Overpayments, including the new Stark self-disclosure protocol. June Crawford, a manager in the Healthcare Compliance Solutions Division at The Bonadio Group, joined Carol and Marcia in a panel discussion addressing compliance program elements, internal audits, and the self-disclosure process.
ICRH Associate Honored by Schenectady County ARC.
Rachel Ryan, an associate of the firm, was honored as a member of The Leadership Tech Valley Class of 2010 at the 2010 ARC Annual Partners Award Dinner on October 5, 2010. LTV Class of 2010 received the Community Volunteer Award for the tremendous effort and work it put towards creating the Schenectady ARC Princetown Ridge Day Pavilion. The brand new, rock-solid, wood-framed pavilion was a result of months of fundraising, securing donated materials and equipment, and the volunteer labor of the LTV Class of 2010. The pavilion replaced a temporary structure that was destroyed by heavy wind, and now serves the recreational and therapeutic needs of hundreds of developmentally disabled Schenectady ARC participants. Rachel Ryan, an associate in the Albany office, participated in the 2010 “Fore the Foundation” golf tournament on September 13, 2010. All proceeds from the tournament will be used to ensure that residents in the community have access to the highest quality home healthcare, regardless of their medical insurance coverage, through the services of the Visiting Nurse Service of Schenectady and Saratoga Counties.

ICRH’s new health care blog is now on line. The blog covers topics of interest to health care providers, attorneys, physicians, policymakers and payors. The focus is on identifying and describing the legal impediments to health care reform and providing practical advice on how they can be overcome. Partner Joshua Mackey Appointed To The Town Of Washington Master Plan Committee.
Partner Joshua Mackey has been appointed to the Town of Washington Master Plan Committee by the town board. Josh also serves as chair of the Town of Washington Planning Board, and in that capacity will be guided by the new Master Plan. The town’s current Master Plan was created in 1987, and the new committee has been charged with updating the plan. The new Master Plan will lay the groundwork for future zoning requirements. The process of drafting a new plan includes not only members of the committee and town board, but solicits input from the entire Town of Washington community through public meetings and workshops.
Associate Attends Event For Breast Cancer Awareness Month
Michelle Almeida, an associate in the firm’s Poughkeepsie office, attended “Think Pink” on October 5, 2010, at The River Station in Poughkeepsie to benefit the Miles of Hope Breast Cancer Foundation. The event was hosted by the Dutchess County Regional Chamber of Commerce and the American Cancer Society, and marked the chamber’s fifth annual Think Pink event. In support of the event, the Mid-Hudson Bridge was lit in pink lights during a fireworks show to help raise public awareness about National Breast Cancer Awareness month in October. The Miles of Hope Breast Cancer Foundation was established to fund support services for people in the Hudson Valley community who are fighting breast cancer.
ICRH Associate to Participate in FBI Program
Marc Antonucci, an associate in the firm’s Albany office, has been selected to participate in the Albany Division of the Federal Bureau of Investigation’s (FBI) Citizens’ Academy. The Academy is limited to approximately twenty business, civic, religious and community leaders who have demonstrated a commitment to community service. The six-week program affords community leaders in the Albany area an inside look at the FBI, and fosters a greater understanding of the FBI’s role in the community. The curriculum utilizes traditional methods used at the FBI Academy in Quantico, Virginia. Participants are introduced to the structure and operation of the Albany Division, including a description and discussion of investigative techniques utilized in both criminal and foreign counterintelligence/terrorism investigations, evidence recovery and firearms demonstration.

Michael Deyo, an associate in the firm’s Albany office, was quoted in an article published by the Albany Times Union, in connection with the electronic discovery and email retention responsibilities of public school systems. Deyo, who is an Adjunct Professor at Albany Law School on the subject of electronic discovery, is experienced in email preservation and electronic discovery issues related to state agencies, municipalities and other public institutions.

The firm hosted a reception for the National Society of Professional Insurance Investigators (NSPII) at its Poughkeepsie, New York, office on September 14, 2010. NSPII is a non-profit organization dedicated to furthering investigative ideas, procedures and techniques. NSPII sponsors annual, national and regional seminars, publishes a newsletter, and conducts regular meetings to inform and develop professionals in the areas of insurance fraud recognition, prevention and investigation. Partner Marcia Smith was honored at The Long Island Home’s Fifth Annual Golf Classic
Partner Marcia Smith was honored at The Long Island Home’s Fifth Annual Golf Classic on June 21, 2010. Ms. Smith was recognized for her advice and guidance with respect to not-for-profit issues and health care law, as well as her personal commitment to providing legal counsel to The Long Island Home. The Long Island Home consists of South Oaks Hospital, a psychiatric hospital that serves the mental health needs of Nassau and Suffolk counties; and Broadlawn Manor Nursing & Rehabilitation Center, a residential nursing facility. The event was attended by more than 200 people and raised $40,000 toward the funding of a new Outpatient Child and Adolescent Clinic, which will help individuals up to 18 years of age and their families. Ms. Smith has served as outside general counsel to The Long Island Home since it was converted from a for-profit shareholder corporation to a not-for-profit corporation in 1999.

ICRH was a corporate sponsor of the "Touch-A-Truck" event organized by Young Leaders United in Dutchess County on June 6, 2010. Omer Gil, an associate in the Poughkeepsie office, is a co-chair of Young Leaders United. Touch-A-Truck is a community-wide event where children have an opportunity to see, touch, interact with and learn about dozens of different types of vehicles. There were 39 vehicles at the event, including a fire truck, cement truck, tow truck, armored car, ambulance, bus, and even a helicopter. Associate Penny Hahn was elected to the board of directors of the Mid-Hudson Valley Women's Bar Association for a second term as Vice President for the 2010-2011 term. The Mid-Hudson Valley Women's Bar Association, which encompasses Dutchess and Ulster counties, is a Chapter of the Women's Bar Association of the State of New York. WBASNY is the only statewide bar association dedicated to promoting the advancement of women in society and in the legal profession. ICRH Associate Reappointed to the New York State Bar Association House of Delegates
Rachel Ryan, an associate in the firm's Albany office, was reappointed to the New York State Bar Association House of Delegates as a member representing persons of racial and ethnic diversity. Over the past year, Rachel has helped the House of Delegates consider important issues, including support for solo and small firm practitioners and a model policy to assist law firms and legal departments in dealing with impairment issues.

Partner Josh Mackey appeared on the Dutchess County Regional Chamber of Commerce Coffee Break radio show which aired April 20, 2010, on 1260 AM WBNR. The program is hosted by Charles S. Partner Josh Mackey attended the American Red Cross Dutchess County Chapter 100th Anniversary Red Tie Event on March 18, 2010 at the Grandview Hotel in Poughkeepsie, New York where community leaders from throughout the area gathered to celebrate the occasion and honor supporters.

ICRH Partners to Speak at Compliance Officer Development Series
Partners Carol Hyde and Marcia Smith will speak on the topics of the federal False Claims Act and the voluntary disclosure and repayment of Medicare and Medicaid overpayments at the Rochester and Albany sessions of the Bonadio Group’s Compliance Officer Development Series. The False Claims Act imposes substantial civil penalties and treble damages on federal contractors (including health care providers that participate in Medicare or Medicaid) that knowingly submit false claims or that knowingly retain overpayments. The FCA also permits people who are not affiliated with the government to file lawsuits against federal contractors for violations of the FCA (informally known as "whistleblowing"). The Rochester seminar will be held Monday, April 26, at the Woodcliff Hotel and Spa. The Albany seminar will be held Tuesday, May 11, at the Albany Marriott. Partner Josh Mackey moderated a training session entitled, "On the Same Page: From the Quill to the Missive" at the Council on Litigation annual conference held on March 24 - 26, 2010, in Ponte Vedra, Florida. In this entertaining presentation, the modern topics of coverage determination and reservation of rights issues were addressed by using quotes from the works of William Shakespeare. Educational sessions used Shakespeare's prose to illustrate the importance of making the right coverage decisions, the method by which such decisions must be made, and the unintended results when such decisions are not made properly. Further, the presenters focused on the importance of counsel and company remaining on the same page during the coverage analysis and conveyance of the coverage decision. Partner Richard A. Frankel was recently recognized by Martindale Hubbell as an AV-rated attorney, the highest rating available to an individual lawyer. ICRH Matches Employee Contributions to Aid Earthquake Victims
In response to the need for assistance in Haiti, the firm notified all employees that their personal contributions to charities assisting victims of the earthquake will be matched by the firm. The matching contribution will be made to the Clinton Bush Haiti Fund, chaired by former presidents Bill Clinton and George W. Bush.
