Mr. Cunningham concentrates his practice in the areas of
commercial and personal injury litigation. He has litigated
numerous cases arising from construction delays, environmental
pollution, explosions, floods, industrial accidents, structural
failures and other catastrophic events. These engagements
have required a working knowledge of technical issues in
a variety of fields, including automotive engineering, bridge
design, civil engineering, concrete technology, explosive
and pyrotechnic chemistry, highway design, hydrology, machine
design, medical devices, pharmaceuticals, propane systems
and underwater blasting. Among the significant cases he
has handled are the Empire State Plaza (Albany) construction
delays, the New York State Thruway (Schoharie) Bridge collapse,
the St. Lawrence Canal flood at Whitehall, New York, and
the Queensboro Bridge (New York City) rehabilitation project
delays.
Mr. Cunningham’s commercial litigation practice has
included representation of construction firms, design professionals,
hospitals, insurance carriers, law firms, manufacturers,
health maintenance organizations, nursing homes, retailers,
trade associations and shareholders. He is also experienced
in both the prosecution and defense of suits involving product
design, professional malpractice, pharmaceuticals, industrial
safety, motor vehicle crashes and fires.
Mr. Cunningham is admitted to practice in the courts of
New York, the United States District Courts for the Eastern,
Northern, Southern, and Western Districts of New York, the
United States Court of Appeals for the Second Circuit, and
the United States Supreme Court. He has served as Family
Court law guardian and as appointed counsel in criminal
cases before the state and federal trial and appellate courts.
Mr. Cunningham has lectured for the Trial Lawyers Section
of the New York State Bar Association and is a member of
the New York State and Albany County Bar Associations, the
Association of Trial Lawyers of America, and the New York
State Trial Lawyers Association. Mr. Cunningham carries
the highest rating (AV) from the Martindale-Hubbell lawyer
registry, which lists attorneys based solely upon peer evaluations.
A native of Albany, Mr. Cunningham graduated from Christian
Brothers Academy and received a Bachelor of Arts degree
(with honor) from Manhattan College. He also studied at
the Albert-Ludwigs Universität, Freiburg, Germany.
Mr. Cunningham received his law degree (cum laude)
from the University of Notre Dame Law School, where he served
as Executive Editor of the Law Review. Prior to entering
private practice, he completed a one-year term as law clerk
to the Honorable Edward A. Tamm, United States Court of
Appeals, District of Columbia Circuit. Mr. Cunningham has
also served as a board member and officer of the Legal Aid
Society of Northeastern New York and a member of the Board
of Governors of the Doane Stuart School.
