Mr. Mitchell concentrates his practice in the areas of banking,
bankruptcy, workouts and commercial litigation, as well
as health care, corporate and transactional matters. Mr.
Mitchell’s banking practice includes representation
of major banks and corporations as lenders, both secured
and unsecured, in Chapter 7, 11 and 13 cases throughout
New York. He has handled bankruptcies in such diverse fields
as construction, health care and retail.
Mr. Mitchell’s health care practice includes representation
of physicians with respect to practice formation, choice
of entity, governance, employment agreements, and regulatory
compliance. He has negotiated exclusive contracts, recruiting
agreements, and other contracts with hospitals, and has
represented health care clients in mergers and acquisitions.
Mr. Mitchell is admitted to practice in the courts of New
York, the United States District Courts for the Northern,
Southern and Eastern Districts of New York, and the United
States Court of Appeals for the Second Circuit. He is a
member of the Dutchess County, New York State and American
Bar Associations, the Mid-Hudson Bankruptcy Bar Association
(past president), Federal Bar Council, the American Bankruptcy
Institute, and the American Health Lawyers Association.
In addition, Mr. Mitchell served on the New York State Judicial
Screening Committee for Dutchess County from 1992-98. He
has lectured numerous times for both the New York State
Bar Association and the National Business Institute on bankruptcy,
foreclosure and commercial litigation issues.
Mr. Mitchell has always been active in community organizations.
He is the Chairman of the Board of Directors of United Way
of Dutchess County. In 1995 he
served as the Campaign Chair,
helping raise more than $4 million, and was the recipient
of the 1996 Alexis de Tocqueville Society Award, recognizing
his community leadership. Mr. Mitchell is currently chairman
of the Planning Committee for the United Way. For more than
ten years he has served the Community Foundation of Dutchess
County (past president), and remains an active member of
its investment committee. He is a former director of the
Vassar Brothers Hospital Foundation, the American Heart
Association (Dutchess County Region, as well as the New
York State Affiliate), the Bardavon 1869 Opera House, and
the Dutchess County Boy Scout Council.
Mr. Mitchell is a life-long resident of Poughkeepsie. He
received his Bachelor of Arts degree from the University
of Pennsylvania and his law degree from Albany Law School
of Union University. Before joining Iseman, Cunningham,
Riester & Hyde, LLP, as a partner in 2002, Mr. Mitchell
was a partner in the Poughkeepsie law firm of McCabe &
Mack for more than 20 years. |
