Rachel
Ryan, associate in our Albany
office, attended St. Peter’s Hospital
Foundation’s 9th Annual Holiday Kick-Off
Celebration at the Fort Orange Club, in Albany,
NY on November 23, 2007. The donations for this
year’s event will be used to help to offset
the investment by St. Peter’s Hospital
in the new da Vinci ® Surgical System which
assists St. Peter’s Hospital’s work
in the area of Minimally Invasive Surgery.
Penny
M. Hahn and Marc A. Antonucci Join Iseman, Cunningham,
Riester & Hyde, LLP
The firm is pleased to announce that Penny M.
Hahn and Marc A. Antonucci have joined the firm
as Associates.
Ms. Hahn is an Associate in our Poughkeepsie
office, where she concentrates her practice
in Insurance Fraud Law. She earned a Bachelor
of Science degree (summa cum laude)
from Charleston Southern University and received
her Juris Doctor from Washington and Lee University
School of Law. She is admitted to practice before
the courts of the State of New York.
Mr. Antonucci is an Associate in our Albany
office, where he concentrates his practice in
the areas of civil and criminal litigation.
He earned a Bachelor of Arts degree from the
State University of New York at Albany and received
his Juris Doctor (cum laude) from Roger
Williams University School of Law. He recently
served as a law clerk with the Rhode Island
Supreme Court Law Department. He is admitted
to practice before the courts of New York.
Robert
H. Iseman, Partner with the
firm, was a contributor to the New York State
Bar Association’s Health Law Section Fall
Meeting which was held at The Otesaga Hotel
in Cooperstown, New York on November 3, 2007.
Marcia B. Smith, another Partner with the firm,
was one of the Co-Chairs of this event. The
program was entitled “Medicaid Fraud:
New Era, New Forces, New (and old) Problems.”

Marcia B. Smith,

Carol
A. Hyde, Partner with the Firm, recently
spoke on the topic of “The Healthcare Industry
in New York” at the New York State Bar Association’s
continuing legal education seminar “An Introduction
to Health Law.” The day-long seminar was held
on May 17, 2007 in Albany, New York.
Justin
Gray, Associate with the Firm, recently
completed “Leadership Dutchess,” the signature
program of the Greater Southern Dutchess Chamber of
Commerce for the past 18 years. Leadership Dutchess
is designed to foster the development of a select
group of professionals who grow and learn together
over an eight-mon|h period through a variety of experiences
including discussions, interactive exercises, experiential

Laurie
K. Chisolm Joins Iseman, Cunningham, Riester &
Hyde, LLP
The Firm is pleased to announce that Laurie K. Chisolm
has joined the Albany office as an Associate. Ms.
Chisolm focuses her practice on commercial litigation.
She is a graduate of New York Law School (magna
cum laude) and the University of California at
Santa Barbara. Ms. Chisolm also received an L.L.M.
from Columbia University School of Law. She is admitted
to practice in New York and Vermont.
Richard
A. Mitchell, Partner with the Firm,
is currently serving as Chairman of the Board of United
Way of Dutchess County. Rick has a long history of
involvement in the Dutchess County community. He has
served on many boards and was chairman of the American
Heart Association, Dutchess County Region, from 1990
to 1992. He also was president of the Area Fund of
Dutchess County, now the Community Foundation of Dutchess
County, for 1993 and 1994.
His involvement with the United Way goes back to when
he returned to Poughkeepsie after law school in 1974.
He has held many different jobs with the United Way
over the years, including board member from 1978-1992
and 1994 to present; campaign chair in 1995, when
he helped United Way raise $5.2 million; vice chairman
from 2005-2006; and he is now serving a two-year term
as chairman of the board from 2006-2008.
United Way of Dutchess County is a countywide organization
attracting more than 2000 volunteers on an annual
basis. It raises money primarily from employers and
employees in the county and then allocates funds to
various programs for those less fortunate in Dutchess

Marcia
B. Smith, Partner with the Firm,
has been appointed to the Board of Directors of
Wiawaka Holiday House, Inc. Wiawaka is a century
old women’s retreat on Lake George. Its mission
is to provide a nonsectarian retreat and educational
center dedicated to enriching the lives of working
women and helping disadvantaged women. It is also

in a roundtable discussion on Diversity in the Legal
Profession at Albany Law School on Tuesday, March

Lydia Hoffman Meunier recently addressed the 24th
Annual Conference of the Counseling Centers of New
York, an organization of college counselors affiliated
with colleges and universities in New York State.
The pre-conference seminar entitled “Suicide
on the College Campus, Issues of Treatment, Intervention,
Policy and the Law” was held at Rensselaer Polytechnic
Institute on June 6, 2006.
Ms. Meunier discussed recent lawsuits involving educational
institutions who are defending charges related to
their handling of students with mental illness, and
offered counsel on preventing institutional liability.
An article written by Ms. Meunier entitled “Mental
Health Issues on College Campuses” was published
in the Spring 2006 issue of the Health Law Journal,
published by the New York State Bar Association. The
article discusses the nature of liability faced by
schools in addressing the needs of mentally ill students
and contains a series of measure schools should consider
to defend against potential liability. The article

CHARITIES IN NEW YORK SEMINAR
MARCH 22, 2006, ALBANY, NEW YORK
Paul A. Gillan, Carol A. Hyde, Marcia B. Smith and
Karen E. Sosler were presenters at the Lorman seminar
“Public Charities in New York” on March
22, 2006 in Albany, New York. This one-day seminar
highlighted organizing a public charity in New York,
the regulation of public charities, corporate governance
and related legal issues, current developments, IRS
compensation audits and joint ventures with for-profit
organizations. Additional presenters included a representative
of the New York State Attorney General Charities Fraud
Bureau and an accountant specializing in not-for-profit
work.

MARCIA B. SMITH’S HEALTH LAW PRESENTATION
Marcia B. Smith, a partner at Iseman, Cunningham,
Riester & Hyde, LLP, was one of the presenters
at the New York State Bar Association’s Health
Law Section’s Fall Meeting at The Sagamore in
Bolton Landing, New York, on October 28-29, 2005.
The topic of the meeting was “The New Medicaid
Fraud and Overpayment Initiative: Representing Health
Care Providers in Medicaid Audits.” Ms. Smith
was a speaker in two different sessions: “Ethical
Issues in Medicaid Fraud and Overpayment Cases”
and “The Prosecution and Defense of a Hypothetical
Medicaid Audit Case.”
Among the points she raised in the first session,
Ms. Smith said, “The New York Code of Professional
Responsibility is the legal profession’s way
of limiting attorneys from using their informational
advantage to serve their own agenda. Many of the rules
are intended to require attorneys to see things from
their client’s point of view and put their interests
before their own.” Ms. Smith cited numerous
specifics, from the Medicare disclosure statute to

Ms. Smith handles regulatory and transactional matters
for a wide range of health care clients, including
health care systems, hospitals, physicians and insurers.
She assists health care providers in structuring joint
ventures, transactions and acquisitions to comply
with the evolving regulatory environment, and advises
clients on governance, licensure, tax exemption, and
Medicare and Medicaid billing matters. She has lectured
on various health care topics, including corporate
compliance, HIPAA, medical records and confidentiality
and antitrust issues affecting multi-provider networks.
Currently Ms. Smith is the Chair of the New York State
Bar Association Health Law Section’s Compliance
and Fraud and Abuse Committee. |

JOSHUA
E. MACKEY JOINS ISEMAN, CUNNINGHAM, RIESTER &
HYDE, LLP
Iseman, Cunningham, Riester & Hyde, LLP, is pleased
to announce that Joshua E. Mackey, a native of Poughkeepsie,
is now of counsel to the firm in the Poughkeepsie
office.
Josh has joined the firm’s litigation practice,
where he concentrates in Insurance Fraud Law. His
litigation background includes extensive experience
in insurance fraud prevention, investigation, and
defense of no-fault, liability, automobile theft,
and arson claims. Josh also has conducted SIU (Special
Investigative Unit) training for major insurance companies
and Fortune 500 companies.
Before joining ICRH, Josh was a partner in McDonough
Marcus Cohn Tretter Heller & Kanca, LLP. Prior
to that, he was a partner in a New York City insurance
defense firm.
Josh is admitted to practice before the courts of
the State of New York. He is a member of the New York
State Bar Association; Association of Certified Fraud
Examiners; New York Anti-Car Theft & Fraud Association,
Inc.; and the New York County Lawyers Association.
He also has served on his local homeowner association
board.
A graduate of Assumption College, Josh was a program
assistant with the Dutchess County Economic Development
Corporation before attending law school. He earned
his J.D. from Brooklyn Law School.
