Litigation: Antitrust
We have litigated many cases brought under the state and federal antitrust laws and broader commercial claims that involved antitrust issues. We have worked with nationally known economists in defense of some of these claims.
Our experience includes:
- We represented St. Peter's Hospital as counsel of record in a large antitrust class action commenced by certain nurses who have alleged conspiratorial conduct among local hospitals in the area of wages. We note that four other local hospitals also were sued in this case, and all of them employed large, national law firms to defend them. The case was settled for nuisance value after a defendant's victory on plaintiffs' motion for class certification.
Outside of the health care area, we have also defended and prosecuted antitrust claims. Examples include the following:
- Defense of allegations that a large supermarket competitor was acquiring or tying up all available sites for development as a means of excluding competitors
- Defense of antitrust issues in connection with a retail sales dealer termination case
- Defense of a price-fixing class action suit brought against an organization of realtors
- Prosecution of a price-fixing claim on behalf of a gasoline retail chain
