Pomona Medical Diagnostic, P.C., a/a/o Daniel Beremo, Jonathan Granados v. Hanover Insurance Company, Index No. CV-046741-09-BX (Civ. Ct. Bronx Cty, March 15, 2011)

Lead Practice Area: Insurance Fraud

Summary: The plaintiff in this case billed our client, Hanover Insurance Company, more than $8,000 for medical services allegedly rendered to plaintiff’s assignors after the assignors were involved in a motor vehicle accident. However, Hanover’s investigation of the underlying collision concluded it had been staged by plaintiff’s assignors for the purpose of defrauding Hanover. Our firm worked with Hanover’s investigators to compile the necessary information and evidence to support Hanover’s position that the collision had been staged. The evidence was presented in a motion for summary judgment argued before the court on March 15, 2011. The court agreed with Hanover that there was sufficient documentation to conclude the collision had been staged and was fraudulent; thus no coverage existed for plaintiff’s claims. The court dismissed the matter in its entirety.
